When you use re captcha the Privacy Terms panel overlap (right) element of the page.
You can always scroll to see what is under unless you are at the bottom of the page where the footer and bottom_modules elements are under it.When recaptcha is enable we should add a margin-bottom so it is always possible to see the footer content.
